What does full legal custody of a child mean?

What is Sole Custody? The term sole custody means one parent can make decisions with respect to their child including with respect to their living arrangements, care and welfare.

Are grandparents legally responsible for grandchildren?

According to the legislation of the Family Law Act 1975, there is nothing specifically that refers to grandparents rights to see or to care for their grandchildren. Nor, in fact, do the parents themselves have automatic parental rights. Parents have responsibilities towards their children.

Can a grandparent have parental responsibility?

As a grandparent you do not have parental responsibility for your grandchild. The parents would normally have parental responsibility and as a result are able to make the decisions about the day to day care and welfare of the child unless the Court makes an alternative order.

Do grandparent rights exist?

Per California law, if you are a grandparent, you may request the court for reasonable visitation with your grandchild. However, certain requirements must be met before you will be granted such visitation. For one, the court must find that you, as the grandparent, have a pre-existing relationship with your grandchild.

Do I have to let grandparents see my child?

Unless a grandparent has secured a court order granting them visitation, a parent is under no legal obligation to allow a grandparent to see their grandchild. However, in most states, courts will consider grandparent visitation even if both parents are alive, married, and generally good parents.

Can a grandparent keep a child from its mother?

Even though a grandparent may gain custody of a child, the child’s parents will retain parental rights. This is especially true if both parents are still alive. Unless the parents consent to give up their custody rights, a grandparent may need to show that both parents are unfit to have custody of a child.
